Kampala — The High Court has dismissed an application by Lwemiyaga Member of Parliament Theodore Ssekikubo seeking permission to appeal against the Electoral Commission and the Ssembabule District Returning Officer over the nomination of Gen. Emmanuel Rwashande.
In a ruling delivered by High Court judge Joyce Kavuma, the court found that Ssekikubo’s application lacked merit. The judge further ordered each party to bear its own legal costs.
Ssekikubo had asked the court to allow him to appeal out of time, arguing that Gen. Rwashande was wrongly nominated to contest for the Lwemiyaga parliamentary seat during the recent general elections and did not meet the required qualifications.
He had earlier lodged a complaint with the Electoral Commission challenging Rwashande’s eligibility. However, the commission upheld the nomination, confirming that Rwashande was duly qualified to contest.
Dissatisfied with that decision, Ssekikubo intended to appeal but failed to do so within the legally prescribed timeframe. He later petitioned the High Court to grant him leave to appeal after the deadline had elapsed.
In her ruling, Justice Kavuma rejected the request, stating that the application did not present sufficient grounds to warrant the court’s intervention.
The decision brings to a close Ssekikubo’s latest legal challenge arising from the disputed nomination in the Lwemiyaga parliamentary race.
